Dahlia Tuber Terms of Sale

These Dahlia Tuber Terms of Sale ("Tuber Terms") govern every purchase of dahlia tubers from Franklin & Co. Flower Farm Inc. (the "Farm"), whether made online or in person, and apply in addition to the Farm's Terms and Conditions. In the event of a conflict, these Tuber Terms prevail with respect to dahlia tubers. By placing an order, the purchaser (the "Purchaser") agrees to be bound by these Tuber Terms.

1. Product

1.1 Unless a listing expressly states that it is a multi-pack, each listing is for one (1) dahlia tuber.
1.2 The Farm warrants only that each tuber, at the time of delivery, is viable, true to variety, and has at least one eye and an intact, healthy neck (the "Limited Warranty"). No other warranty or condition, express or implied, including any warranty of merchantability, fitness for a particular purpose, growth, bloom, yield or performance, is given, to the fullest extent permitted by law.
1.3 Photographs and descriptions depict the variety as grown by the Farm in growing zone 3 and are provided for reference only. Bloom colour, size, form and habit vary with climate, soil, light, cultivation and season, and such variation does not constitute a defect.

2. Orders

2.1 Once an order has been placed, it may not be amended, and items may not be added or removed. Additional items require a separate order.
2.2 The Farm ships within Canada only and does not accept international orders.

3. Shipping

3.1 Tubers ship beginning May 1 of each year, subject to weather. The Farm may delay shipment where conditions in transit or at the destination are likely to damage the tubers.
3.2 Risk of loss passes to the Purchaser upon delivery to the carrier's delivery address provided by the Purchaser.

4. Inspection and Claims

4.1 The Purchaser shall inspect all tubers immediately upon receipt.
4.2 Any claim under the Limited Warranty must be submitted by email to hello@franklinandcoflowerfarm.ca, with the order number and photographs of the tubers, within seven (7) days of delivery (the "Claim Period"). Claims submitted through social media or by any other means will not be accepted.
4.3 The Farm will review each claim submitted within the Claim Period. Any remedy, including replacement or refund of the purchase price of the affected tuber, is at the sole discretion of the Farm. The Farm's total liability for any claim shall not exceed the purchase price of the affected tuber.

5. Transfer of Responsibility

5.1 Upon expiry of the Claim Period, the Purchaser accepts the tubers as conforming and assumes full and sole responsibility for them.
5.2 The Farm shall have no liability, whether during or after the Claim Period, for any loss, damage, failure to sprout, failure to thrive, poor performance or death of any tuber or plant arising from or attributable to storage, handling, planting, cultivation or care by the Purchaser or any third party, grower error, soil or site conditions, weather, frost, pests, disease acquired after delivery, or negligence of any person other than the Farm.
5.3 No claim of any kind will be accepted after the Claim Period.

6. General

6.1 These Tuber Terms are governed by the laws of the Province of British Columbia and the federal laws of Canada applicable therein.
6.2 If any provision of these Tuber Terms is found invalid or unenforceable, the remaining provisions shall continue in full force and effect.
