Farm Visit Terms, Release & Assumption of Risk

Please read carefully. This document affects your legal rights, including your right to sue. By buying a ticket, booking, or entering the farm, you agree to these terms.

1. Who and what this covers

These terms apply to anyone who enters Franklin & Co. Flower Farm at 13492 271 Road, Charlie Lake, BC (the "Farm"), for any reason, including u-pick, events, workshops, date nights, markets, private field rentals, photography sessions, tours and visits to the Flower Shack. "We" and "us" means Franklin & Co. Flower Farm Inc. and its owners, staff, volunteers and contractors.

2. The Farm is a working farm

Visiting a working flower farm involves risks that cannot be removed without changing what the Farm is. These include, among others: uneven, wet, muddy or slippery ground; holes, ruts and rocks; irrigation lines, landscape fabric, stakes, hoops, rebar, netting and other field equipment; plant supports and structures such as greenhouses, tunnels and tents; sharp tools such as snips and scissors; thorns, sap, pollen and plants that may irritate skin or cause allergic reactions; bees, wasps and other insects; wildlife; sun, heat, cold, wind, rain and sudden weather; farm vehicles and equipment; vehicles in parking areas; and the actions of other visitors.

3. Assumption of risk

You understand these risks and choose to accept them. You are responsible for your own safety, for wearing suitable clothing and closed-toe footwear, for bringing sun and insect protection, and for any medication you may need, including for allergies or bee stings.

4. Release of liability

To the fullest extent permitted by law, you release and waive all claims against us for any injury, illness, death, loss or damage to you or your property arising from your visit to the Farm, including claims caused by our negligence, breach of contract, or breach of any duty of care, including under the Occupiers Liability Act of British Columbia.

5. Children

Children must be accompanied and supervised by a responsible adult at all times. The adult who brings or buys a ticket for a child is responsible for that child's supervision, conduct and safety, and agrees to these terms on their own behalf.

6. Farm rules

  • Stay on paths and in areas that are open to visitors. Do not enter areas that are roped off, signed as closed, or used for equipment.
  • Use only the snips or tools we provide, as shown by our staff, and cut only the flowers you are directed to.
  • Follow instructions from our staff at all times. We may ask anyone who does not follow the rules or who puts themselves or others at risk to leave, without a refund.
  • All visits, u-picks and events go ahead rain or shine. In the event of extreme weather, we will contact you to reschedule. We may also close fields or end a visit early for safety reasons.
  • All ticket sales are final. Some events offer cancellation up to 24 hours before the event; where that applies, it is stated on the event listing.
  • Pets are not permitted on the Farm.

7. Medical care

If you are injured or become ill, you agree that we may arrange first aid or call emergency services on your behalf, at your cost.

8. Indemnity

You agree to be responsible for, and to reimburse us for, any claims, costs or damages that result from your breach of these terms or from your actions, or the actions of anyone you bring, while on the Farm.

9. Photos

Photographs and video are regularly taken on the Farm. By purchasing a ticket or entering the Farm property, you acknowledge that you, and anyone attending with you, may be photographed or filmed, and you consent to the Farm using those images on its website, social media and marketing materials without compensation. If you would prefer not to appear, please let a staff member know on arrival.

10. General

These terms are governed by the laws of British Columbia. If any part is found to be unenforceable, the rest stays in effect. These terms apply in addition to our Terms and Conditions.

By purchasing a ticket, making a booking, or entering the Farm, you confirm that you have read and understood these terms, that you accept the risks described, and that you are giving up certain legal rights, including the right to sue us.
