Terms of service

Welcome to Franklin & Co. Flower Farm Inc. ("we," "us," "our," or "the Farm"). These Terms and Conditions govern your use of our website, services, and any transactions with us, whether online or in person. By accessing or using our services, you agree to comply with and be bound by these Terms and Conditions.

Please read these terms carefully. If you do not agree to these terms, you should not use our website or services.

1. Definitions

"Customer" or "you": Any individual, organization, or entity purchasing products or services from Franklin & Co. Flower Farm Inc.
"Products": Flowers, plants, and related items sold by Franklin & Co. Flower Farm Inc.
"Services": The sale, delivery, consultation, and other flower-related services offered by Franklin & Co. Flower Farm Inc.

2. Orders and Payment

Placing Orders: Orders can be placed online through our website or via direct communication with our team. All orders are subject to acceptance and availability.
Pricing: All prices are in Canadian dollars (CAD). We reserve the right to change prices without prior notice.
Payment: Payment is required at the time of purchase unless otherwise agreed. We accept all major credit cards, e-transfers, and other payment methods specified at checkout.

3. Shipping and Delivery

Delivery Within Canada Only: We offer delivery services within Canada. Delivery fees and timeframes are specified at the time of order.
Pickup: Orders can be picked up from our Flower Shack located on the Farm at 13492 271 Road, Charlie Lake, BC V1J 8K2, by prior arrangement, if you select local pickup.
Risk of Loss: Once the products are delivered to the delivery address specified by the customer, the risk of loss or damage passes to the customer.

4. Returns and Refunds

All Sales Final: All sales are final, including all purchases made at the Flower Shack and all bouquet purchases. We do not accept returns or exchanges.
Perishable Goods: Due to the perishable nature of flowers, we do not offer refunds or exchanges for products that have already been delivered or collected unless there is a defect or issue that is directly attributable to us.
Quality Assurance: If you receive a product that is damaged or not as described, please contact us within 24 hours of delivery. We will review the matter, and any replacement or refund is at our sole discretion.
Events: Some events offer cancellation up to 24 hours before the event. Where that applies, it is stated on the event listing. Otherwise, event tickets are final.

5. Use of Website

Content: All text, images, graphics, and other content on our website are the property of Franklin & Co. Flower Farm Inc. You may not use, reproduce, or distribute any content from our website without prior written consent.
User Conduct: You agree to use our website in a lawful manner and refrain from any activity that could harm the site or its users.

6. Notices

When you register with Franklin & Co. and/or this Site, you expressly consent to receive any notices, announcements, agreements, disclosures, reports, documents, communications concerning new products or services, or other records or correspondence from Franklin & Co. You consent to receive notices electronically via email.

7. Intellectual Property

Copyright and Trademarks: All intellectual property, including trademarks, logos, and service marks displayed on our site or packaging, is the exclusive property of Franklin & Co. Flower Farm Inc. or our licensors.
Use of Trademarks: You may not use our trademarks or other proprietary graphics without our written permission.

8. Limitation of Liability

Franklin & Co. Flower Farm Inc. shall not be liable for any indirect, incidental, or consequential damages arising out of the use or inability to use our products or services. Our liability in any case shall be limited to the amount paid for the product or service in question.

9. Additional Terms

Some purchases have their own terms, which apply in addition to these: Dahlia Tuber Terms of Sale, Bouquet Subscription Terms, and Farm Visit Terms, Release & Assumption of Risk (for u-pick, events, workshops, markets, field rentals and any other visit to the farm). How we handle your personal information is described in our Privacy Policy.

10. Governing Law

These Terms and Conditions are governed by and construed in accordance with the laws of the Province of British Columbia, Canada. Any disputes arising from these terms will be subject to the jurisdiction of the courts of British Columbia.

11. Changes to Terms

We reserve the right to update or modify these Terms and Conditions at any time without prior notice. Changes will be effective immediately upon posting on our website. Your continued use of our services constitutes acceptance of any changes.
